Since parking enforcement was transferred from the Police to East Renfrewshire Council in April this year and following concerns from businesses and residents a full review of the process is now underway.
The council has additional resources in place to allow the formal review process to be carried out as quickly as possible.
Which areas will be started first?
The commercial areas of Busby Road in Clarkston, Fenwick Road in Giffnock and Main Street in Barrhead are to receive priority in terms of reviewing how appropriate the existing restrictions are.
So, how will the review be carried out?
The following issues have to be considered before any proposals are taken forward including re-visiting the council's existing policies for transport and development as well as future development proposals and potential impacts.
Evidence needs to be collected to determine what travel and parking patterns exist at present. This will include assessing traffic flows, vehicle speeds, parking acts, duration of stay, accidents, the nature/function of the road and location issues. Consideration will also be given to assess any other impacts that may generate additional demand for parking?
What are the different pressures on parking?
There are many road users that are affected by parking restrictions. The Roads Service will seek to address the demand and expectations of all road users an to promote The existing Traffic Regulation Orders (TROs) that are aligned with the needs of local areas. Road Safety will form a key part of any decision making.
The existing TRO’s need to be assessed to consider what they are seeking to achieve locally and also how they relate to each other within the wider local area and all of East Renfrewshire. This will attempt to make traffic restrictions simpler, fairer and easier for the public to understand.
Are the TROs providing a balanced transport system?
Each TRO has to be broken down into it constituent schedules and re-worked length by length, description by description. In doing this we must ask ourselves what are the restrictions, length by length on each road and are they correct? Do they need to be amended, and if so, to what? What will give a balanced approach for all road users? Will this be fair and consistent? Will the restrictions and signs be understood?
This information has to be drawn up and checked by the council’s Legal Services.
The consultation element with stakeholders can be informal to start with, but legally it must start with the Police and formal adverts put in the local press.
The formal consultation is a legal process and has to follow a pre-determined set of rules. The timescales are flexible dependent upon the level of objection and resolution of issues and can end up going to a hearing.
How long will the review of TRO’s take?
The formal process itself is governed by statute and can take anything up to 52+ weeks depending on the level of objections that are received and sustained.
There are eight local area Orders and one Urban Clearway Order and there will be efficiencies generated once the first local area Order is agreed.
